- Asking price; invitation to treat. All listings on this page are displayed as invitations to treat only. The published asking price does not constitute a binding offer for sale. No contract for sale arises unless and until a written sale agreement is signed by duly authorised representatives of both parties. Prices, availability and terms are subject to change or withdrawal at the Seller's sole discretion at any time and without notice.
- Time-limited offers. Any price quoted by the Seller, whether on this website, by email, verbally or otherwise, lapses automatically if not accepted in writing within seven (7) calendar days of issue, or such shorter period as the Seller may specify. After lapse the Seller may amend or withdraw the offer without liability.
- No warranty as to non-infringement. All domains are offered as generic, descriptive or common-use terms. The Seller does not knowingly deal in domain names that incorporate third-party trademarks, but makes no representation, warranty or guarantee that any domain is free from third-party intellectual property claims, will not be the subject of a Nominet DRS or ICANN UDRP complaint, or is suitable or lawful for the Buyer's intended use in any jurisdiction.
- Buyer's due diligence. It is the Buyer's sole and exclusive responsibility to conduct comprehensive registered and unregistered trademark searches in all relevant jurisdictions, to assess passing-off risk, to review Nominet DRS and ICANN UDRP precedent, and to obtain independent legal advice prior to purchase. The Seller accepts no liability whatsoever for the consequences of inadequate due diligence.
- Buyer's indemnity. The Buyer agrees to indemnify, defend and hold harmless Coaley Peak® Ltd, its directors, officers, employees, agents and affiliates against all claims, demands, actions, liabilities, losses, costs and expenses (including reasonable legal fees) arising out of or in connection with the Buyer's use of any domain purchased through this website, any third-party intellectual property claim, any breach of these terms, or any breach of applicable law or regulation in connection with the domain.
- Business and professional buyers only. The website is intended for use by businesses and professional buyers acting in the course of a business. The Buyer warrants that, in entering into a sale agreement, the Buyer is acting in the course of a business or profession and not as a consumer within the meaning of the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
- VAT. All prices are quoted exclusive of VAT. UK VAT at the prevailing rate will be added where applicable. The VAT treatment of supplies to non-UK buyers will be determined in accordance with HMRC rules in force at the date of supply.
- All sales final. Due to the unique nature of domain names, all sales are final and non-refundable once the IPS tag has been transferred. No refunds, exchanges, credits or compensation of any kind will be issued after transfer.
- Anti-money laundering. The Seller reserves the right to require identification documents, evidence of source of funds, and other information necessary to satisfy itself as to the lawful nature of the transaction, and to decline or withdraw from any transaction without giving reasons.
- Limitation of liability. The Seller's total aggregate liability arising from or in connection with any sale is capped at the lower of the purchase price actually paid for the relevant domain and £100. The Seller shall not be liable for any indirect, consequential, special or incidental losses, including loss of profit, revenue, business or goodwill.
- Governing law. All sales are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales. Full terms are set out in our Terms & Conditions.
